I was arrested and sent to prison for domestic assault while helping my fiance' out of a diabetic low..'?
I am in a relationship with a man who has type one diabetes. He has a history of seizures and extreme diabetic lows. I have helped him out of around twenty of these seizures in two years. When he gets low his hearing and vision go in and out. At times I have to hold him down and smack him in the face to keep him awake.
Friday night I came home to find my fiance’ on the couch, pale and low. He was sitting upright with a soda on the table (im guessing he felt low but was too low to focus) my sister and her bodyfriend were with me as we just had a few drinks at the lodge. I started yelling at my fiance asking him what he was doing, screaming his name, and he just stared at me. I smacked him with a flat hand across the face three times to get his attention, my sisters boyfriend (who is new and has no idea what a low even is) called the cops
Long story short my fiance was finally able to drink enough to get him out of the low, just as I was sitting down crying and hysterical the police showed up and asked me what happen. I told them that he was gone all day, and had donated blood, he had been low when i arrived and smacked him across the face several times. I explained he had lows, and then they turned me around and arrested me. My fiance’ who was then finally ok, was trying to tell them that there was no reason to arrest me.
They threw me against the car, (my shoulder and arms are bruised very badly) and me to the station where they told me i was being charged (THEY pressed them) with "domestic assault". I was then taken to the womens prison (highest securtiy) and left there over night waiting for bail. I was released and not allowed to return home or contact my fiance.
I called around and so did my fiance trying to clear it up, and he even went and explained to the states attorney that this was for medical reasons and they shouldnt have charged me.
The next day at court they informed me that charges were dropped. This was the worst experience of my life. I had friends at the prison who work there, officers, and nurses whom now have seen me in prison. I want to know if my rights were violated. I am 25 and have never had any type of crime against me, no parking tickets, speeding tickets, nothing. AND the cop-hwho arrested me had been here before when my fiance’ was low. There are 6 ambulance visits and 2 cop visits from his violent seizures, they knew that I had to use force when his sugar is around 20…….
What are my rights here? Im humiliated, bruised, and I can’t sleep, Im afraid to help again if my fiance’ gets low, but I take care of him and Im scared to do anything!
Frank, Not everyone who has type one needs a smack. But when they have taken too much insulin, weigh 100 pounds more than you and are losing conciousness sometimes you have to act fast, Insulin excessiveness lows are way different than a regular low. blood sugar of 25 and dropping fast is death in a matter of minutes…so don’t tell me not to slap him. I will do what I need to save his life.
I think you were drunk and belligerent when the cops got there and they threw your drunk a$$ in jail.
Be glad you got off like you did.

Haha. Sweet story. I give it an A for effort.

Assuming that’s all true/accurate:
Your rights were certainly not violated. The officer new that you had struck the man. What he did was correct in letting the court decide whether or not you had an affirmative defense/good reason.
It’s an unfortunate situation…but your rights definitely weren’t violated.

He should probably be taking better care of his blood sugar. If his blood sugar is so low that he has to be slapped to get out of it, what’s going to happen some day when you aren’t around to take care of him?
As far as the police go, they acted on the evidence they had available at the time, which is that you had slapped your fiance. That’s a domestic assault and they pretty much have to take you to jail at that point.
Again, if he gets his diabetes under control, you won’t have any of these episodes, and neither will he.

First of all you were not in prison. It was jail. If I responded to your house and you did state you had been drinking and was told you struck your boyfriend several times for a LOW. I would have arrested you. I have a niece who is type 1 and you donot need to smack her at any time. Quit crying and don’t hit your boyfriend anymore.

It’s never ok to slap someone because their blood sugar is getting low. That’s the most ridiculous thing I’ve ever heard of. Look into getting Glucagon or having him go to his doctors and learn how to manage his DM better. Until then, if it happens again, just call an ambulance. Hypoglycemia is a very quick fix and hitting him isn’t going to keep him alive.
